The California Workers Compensation Appeals
Board adjudicates cases in a CA state required insurance program that pays
medical bills and may replace lost wages for California employees who are
injured and / or disabled from work or who have work-related injuries,
occupational diseases or industrial accidents or illnesses.
California Workers Compensation insurance will
pay for the medical treatment of an injury or illness if the injury occurred on
the job, or in the course and scope of work, even if not at work, or the
disease or illness is job-related.
California Workmans Compensation insurance will
also replace some of the worker’s lost wages if the injury or illness caused the
worker to lose some or all income after three days of temporary disability from
a California work injury. (Ask your lawyer!)
An injured worker in California is entitled to
all reasonable medical care and treatment needed to cure or relieve a specific
work-related injury or continuous trauma or repetitive stress or repetative
strain injury. Medical care covered by California Workers Compensation insurance
claims include: medical, surgical and hospital services, dental services,
crutches and orthopedic devices, hearing aids, chiropractic treatment, physical
therapy, nursing care, etc and prescribed medications. California Workmans
Compensation cases cover a variety of work injuries ranging from temporary
disability to total or partial permanent disability.
You may be entitled to a settlement for a
partial permanent disability award if you have permanent work restrictions
imposed because of your work injury or job related injuries. Medical evidence
will determine the extent of your temporary as well as permanent disabilities.
The value of your claim depends, in large part, on the extent of permanent
disability. Your California Workers Comp Lawyer will be able to answer the hard
injury and disability settlement questions for you, and counsel you on:
- a stipulation and award;
- a compromise and release;
- lifetime medical care options;
- California benefits for temporary
disability, permanent disability, partial permanent disability, and 100%
disability;
- California vocational rehabilitation (voc
rehab) California job re-training
You should also be aware that if you were
financially dependent on a deceased California injured worker, you may be
entitled to death benefits from California Workmens Compensation insurance.
Death benefits may be available to any dependent household member of the
deceased California injured worker, not only a spouse or natural child under
California Workman’s Compensation law.
California Workers Compensation laws can be
very complex and confusing. Temporary and Permanent Disability benefits, medical
benefits, injury settlements and death benefits are determined by many Cal labor
codes and laws, specific to California. Understanding the California Workers
Comp system and the Workers Compensation Appeals Board Process will help to calm
your fears and approach the medical and legal process more confidently. Each
