Houston Attorney Brad T. Wyly says homeowners can pursue legal claims against insurers to recover what they are owed for property damages.
Houston, TX, September 13, 2009 -- On the first anniversary of last year's devastating Hurricane Ike, a Houston personal injury attorney says homeowners may need to consider legal action if they still have not reached a satisfactory settlement with their insurance company over property damages.
"My parents lost their house on Galveston Island during the storm, so I have first-hand experience with the devastation the storm caused, and the various insurance issues that arise," said Brad T. Wyly of The Wyly Law Firm, P.C..
Ike made landfall over Galveston, Texas as a Category 2 hurricane on Sept. 13, 2008. Eighty-two U.S. deaths were blamed on the storm, and damages in U.S. coastal and inland areas have been estimated at $24 billion.
With the one-year anniversary of Hurricane Ike at hand, thousands of homeowners in the Houston area are still battling insurance companies over storm damage claims, Wyly said.
In many cases, insurers have agreed to pay for only a small fraction of damages to a home, refusing to pay the full extent of damages demonstrated by their insured or arguing that damages were not covered by the homeowner's policy, he said. These disputes have prevented repairs, leading to increased damages and preventing Texas residents from returning to their homes, Wyly said.
"With the help of an attorney, it may be possible for homeowners to force their insurance company to pay them what they deserve," Wyly said.
Claims against insurance companies for Hurricane Ike damages typically take two forms -- bad faith claims or breach of contract claims. The Wyly Law Firm handles both types of claims, Wyly said, and can provide homeowners with representation over unpaid damages.
