Michigan OWI Offenses
Michigan categorizes drunk-driving offenses in several ways. The Operating While Intoxicated (OWI) charge is the equivalent of a DWI or DUI charge in other parts of the country. The law firm of Paul Tafelski, P.C., is familiar with all of Michigan’s drunk-driving laws and assists clients who are facing OWI charges.
OWI encompasses three primary violations:
- A finding that alcohol or other substances impaired one’s ability to drive safely;
- Tests indicating that the alleged offender had a blood alcohol content (BAC) of 0.08 or higher when stopped by Michigan law enforcement;
- That he or she tested positive for “High BAC” – a blood alcohol content of 0.17 or higher, more than twice the Michigan state limit.
When a driver is stopped for OWI, a police officer may request to conduct a preliminary breath test and/or a standard field sobriety test. The National Highway Transportation Safety Administration has developed a standardized roadside sobriety exam to help officers determine probable cause to arrest suspected offenders for OWI. The field exam includes the pre-arrest screenings for specific physical signs of impairment.
A possible defense in an OWI case is that the police officer failed to perform the field sobriety test according to required protocol or that the breath and blood tests were unreliable. Tafelski uses that evidence in court when dealing with a prosecutor or jury, among other findings from his investigations.
