Mesothelioma is a rare form of cancer without a cure. Mesothelioma victims who have been exposed to asbestos have inhaled or swallowed asbestos fibers. Those fibers attach to mesothelial cells in the pleura (the lining the lungs, known as pleural mesothelioma) or abdominal cavity (peritoneal mesothelioma). Each year another 2,500 to 4,000 mesothelioma victims are diagnosed in the U.S.
The large mesothelioma settlements associated with asbestos lawsuits are not accidental. Jurors who have the opportunity to review mesothelioma trial evidence are outraged by the actions of corporations who sold asbestos products despite knowing about its hazards.

Mesothelioma is not a lung cancer. Smoking does not cause it. The pleura, or thin, Saran Wrap-type membrane that lines and encases the lung, produces a special lubricating fluid that facilitates breathing. Infiltration of asbestos fibers creates changes in the cells, which causes the cancer, known as pleural mesothelioma. Less common is peritoneal mesothelioma, which is a cancer of the membrane that surrounds the lining of the abdomen.
In a typical case, a mesothelioma victim experiences chest pain (usually caused by a build-up of fluid in the pleural space called a pleural effusion) and shortness of breath. Many doctors and pulmonologists do not have expertise in asbestos-related diseases, so these symptoms are often initially considered to be attributable to other medical problems. A pleural tissue biopsy may reveal cancer of the mesothelial cells and a proper diagnosis can be established.
The history of an individual’s occupational exposure to asbestos should be taken. The patient may or may not recall the precise nature of his asbestos exposure. Since there is no “safe” level of exposure, even brief, low level exposures may be enough to cause mesothelioma.
If you or a loved one is experiencing any mesothelioma symptoms, consult your doctor right away. New York mesothelioma cases and other asbestos-related illnesses are debilitating, aggressive conditions. It is important that you file a claim within a specified time period from the date that you receive your mesothelioma diagnosis. If you neglect to pursue NY asbestos litigation within the statute of limitations, you may lose your right to seek damages.
Belluck & Fox, LLP has won a number of major personal injury cases involving asbestos, defective medical products, tobacco and lead paint, including a recent mesothelioma claim that settled for over $12 million.
