About Holiday, Florida Railroad Disability Cases
Unlike most other workers, railroad employees cannot recover benefits from the Social Security Disability program. Railroad workers are instead entitled to benefits from the Railroad Retirement Board (RRB), which is a separate federal agency.
In addition to retirement plans, the RRB also provides disability benefits if a railroad worker becomes disabled before regular retirement age. The RRB has two types of disability benefits — unlike Social Security, which offers only one disability program. If a railroad employee is permanently disabled from all work and has at least 10 years (120 months) of credible railroad service, he or she is entitled to receive total disability from the Railroad Retirement Board. The medical requirements for RRB total disability are similar to those for SSD.
Railroad workers could also be entitled to occupational disability from the Railroad Retirement Board if they have at least 20 years (240 months) of railroad service and they are permanently disabled from their “regular railroad occupation.” There is no requirement that the claimant be unable to perform any substantial gainful employment — the worker simply must be unable to perform his or her job. That is not the case with SSD.
