The philosophy of
General Counsel Mediation,
LLC is that mediation works best when it is conducted by a mediator who is
an active facilitator with an understanding of the substantive issues involved,
and with the ability to help the parties think “outside the box.”
Bruce Deerson, of the Raleigh office, and Jim Puhala, in
Pittsburgh, formed General Counsel Mediation to provide a unique forum for
disputing parties to resolve their disputes in a confidential, non-judgmental
manner. Mediation – a non-binding, facilitated negotiation – provides an
opportunity to avoid litigation altogether, or to resolve litigation at an early
stage, thus avoiding the negatives of the litigation process.
The facilitator is a neutral third party, who helps the
parties to move beyond posturing and seek resolutions that deal effectively with
each party’s concerns. There is a growing trend toward use of mediation,
particularly by parties who have been disappointed with litigation, both as a
process and in its likelihood of achieving a satisfactory result. Mediation has
proven successful in resolving all types of disputes and lawsuits.
Deerson and Puhala are each former Vice Presidents & General
Counsels of NYSE companies who have substantial experience in dealing with and
resolving disputes involving business, commercial, construction, and community
issues. In their role as General Counsel, the pair served as both lawyer and
client. Each has extensive hands-on experience in managing litigation,
conducting win-win negotiations in a broad commercial context, and resolving
disputes through alternative dispute resolution. The firm’s goal, they say, is
to help parties to business disputes put their disputes behind them and get back
to business.
